AI UGC provides AI-generated video content and optional done-for-you (DFY) creative services for marketing and advertising purposes.
2. Nature of the Services
AI UGC provides:
AI-generated video content based on information provided by the customer
Optional DFY services, which may include strategy, creative direction, editing, and delivery
One-time video purchases and recurring service subscriptions
AI UGC does not currently provide a self-serve software platform or user-operated AI tool. Any future SaaS offering will be governed by updated terms.
3. AI-Generated Content Disclaimer
You acknowledge and agree that:
Videos and creative outputs are generated using artificial intelligence systems based on customer-provided information
AI-generated content may contain inaccuracies, inconsistencies, or unintended elements
AI-generated outputs are not guaranteed to be unique
AI UGC does not provide legal, regulatory, advertising, or compliance advice
You are solely responsible for reviewing, validating, and approving all content before use, publication, or distribution.
4. Client Responsibilities
You confirm that:
You have the legal right to provide all information, assets, and instructions submitted to AI UGC
Your use of the delivered content complies with all applicable laws, platform policies, and advertising regulations
You will not use the content for unlawful, deceptive, or misleading purposes
AI UGC is not responsible for how content is ultimately used.
5. Ownership and Intellectual Property
5.1 Your Content
You retain ownership of any materials, information, or assets you provide.
5.2 Delivered Output
Upon full payment, you receive a perpetual, worldwide, royalty-free right to use the delivered AI-generated videos for commercial and non-commercial purposes.
No attribution to AI UGC is required.
5.3 Our Intellectual Property
AI UGC retains all rights to:
Internal processes
Methodologies
AI workflows
Creative frameworks
Branding, website content, and materials
Nothing in these Terms grants you rights to our internal systems or know-how.
6. Payments and Billing
Payments are processed via Stripe
Prices are displayed before purchase and exclude applicable taxes unless stated otherwise
Subscriptions (where applicable) renew automatically until cancelled
All payments are non-refundable, except where required by law.
7. Cancellation and Termination
You may cancel a service subscription according to the terms communicated at purchase
AI UGC may refuse or terminate service if misuse, fraud, or unlawful activity is detected
Termination does not affect your rights to previously delivered and paid-for content.
8. Service Availability
AI UGC aims to deliver services in a timely and professional manner but does not guarantee:
Specific performance outcomes
Advertising results
Platform approval
Continuous availability
Delays may occur due to technical issues, third-party dependencies, or circumstances beyond reasonable control.
9. Limitation of Liability
To the maximum extent permitted by law:
AI UGC shall not be liable for indirect, incidental, or consequential damages
Total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
You use the Services at your own risk.
10. Indemnification
You agree to indemnify and hold harmless AI UGC and Marcus-Aurelius Digital® from any claims, damages, losses, or expenses arising from:
Your use of the delivered content
Your advertising or marketing activities
Your violation of laws, platform policies, or third-party rights
11. Age Restriction
The Services are intended for adults only.
You must be at least 18 years old to use the Site or purchase Services.
12. Privacy
Your use of the Site is also governed by our Privacy Policy, which explains how personal data is collected and processed.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain and applicable European Union law.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Spain.
